Cargo release · PRACTICAL GUIDE
Freight Forwarder Released Cargo Without Authorization
An unauthorised release claim turns on the contractual chain, the release condition, who acted, causation and loss—not simply on who sent the final email.
Reconstruct the release chain
Collect the booking, house and master bills, surrender or telex-release instructions, destination-agent communications and gate or delivery records. Identify the contractual carrier, actual carrier, forwarder and party that physically released the cargo.
Establish the exact condition for release and whether it was varied. Authority should be traced through the complete communication chain.
Protect the recovery position
Send prompt written notices and request preservation of delivery, identity and system records. Consider whether the cargo or proceeds can still be secured.
Assess contractual defences, liability limits, time bars and the relationship between the carriage claim and the unpaid sale price before settling with any participant.
