China litigation · PRACTICAL GUIDE
How Long Does It Take to Sue a Company in China?
There is no single reliable duration for a China lawsuit. Timing depends on jurisdiction, service, evidence, preservation, hearings, appeal and whether enforcement is required.
Separate judgment from recovery
Case filing, service, evidence exchange, hearing and judgment form the first-instance stage. Foreign-party formalities, translation, jurisdiction objections and expert issues can add time.
A first-instance judgment may be appealed. Even a final judgment does not produce payment automatically if the defendant does not comply.
Plan the enforcement stage early
Before filing, confirm the Chinese defendant, available court, asset information and whether preservation is justified. This work may affect recovery more than a nominal procedural estimate.
Counsel should provide a stage-based estimate after reviewing the documents, while explaining the factors outside either party’s control.
