How to Sue a Chinese Supplier

A lawsuit should be the result of an enforcement analysis, not the first reaction to a failed order. The useful question is whether the correct Chinese entity can be identified, sued in an available forum and ultimately made to perform or pay.

Start with the legal identity

The English name on a website or pro forma invoice may not identify the registered company. Obtain the Chinese legal name, unified social credit code, registered address and the identity of the bank-account holder.

If a factory, trading company and payment recipient are different, the evidence must explain which entity made each promise and received each benefit.

Check forum, evidence and assets

Review the governing-law and dispute-resolution clauses before choosing a court or arbitration institution. Preserve executed contracts, purchase orders, payment records, specifications, inspection material and original communications.

A favourable decision has limited commercial value if service is impossible or the defendant has no recoverable assets. An early asset and cost assessment helps choose between demand, settlement, preservation and proceedings.
